Bristol Bay setnetters sue over tender sinking

Several salmon setnetters at the Igushik River, on the west side of Bristol Bay, are suing Trident Seafoods and others over the sinking last summer of the tender Lone Star.

The sinking caused a fuel spill that forced a shutdown of the setnet fishery.

A tender is a vessel used to haul fish to a processing plant. The Lone Star was working for Trident.

In a lawsuit filed in state Superior Court at Dillingham, the setnetters are seeking compensation for lost fishing income and other damages.

The plaintiffs also allege that during salvage of the vessel, salmon off the tender was allowed to wash up on the beach, attracting bears that gorged on the fish and then ransacked setnetter cabins.

What happened was horrible for a lot of different people. However, how is this Tridents fault? Does this lawsuit have legs to stand on? The boat isnt owned by Trident. I guess we will see.

Read the press release... Uh...right...

They are suing the boat owner, the company who leased the boat's services (Trident), AND the salvage crew.

Then their lawyer states that "many more" will be named?

Who is left to sue? The dude who sold the gas to everyone? The companies who made the parts for each ship? Maybe they should sue the bears!

Seriously, reading between the lines is easy on this one. Sadly easy.

There is no doubt insurance to cover actual losses, and when that is used up there is a state fund to kick in. So all real losses should be covered. If this is so, then this is nothing more than a quick pay day for the lawyers. And, their pay comes from the proceeds their clients would have gotten anyway.

It's the American way! I am sure the bears would never have been in the area but for the sinking. Right. What about that stink? It should be compensable. And the suffering that comes from the worry; now that has to be worth a lot. Finally, let's throw in some punitive damages. Get it jacked up to multiple millions. then we got something!

Hope the setnetters got the lawyers on contingency. Good chance of summary judgement for dismissal against some of the named parties. They might as well have named the bears as well...
